{"id":18100,"date":"2021-04-18T11:44:57","date_gmt":"2021-04-18T11:44:57","guid":{"rendered":"https:\/\/sampingan.co.id\/?p=18100"},"modified":"2021-04-18T11:44:57","modified_gmt":"2021-04-18T11:44:57","slug":"contoh-surat-peringatan-karyawan","status":"publish","type":"post","link":"https:\/\/staffinc.co\/wawasan\/business-insights\/contoh-surat-peringatan-karyawan","title":{"rendered":"Contoh Surat Peringatan Karyawan Tidak Disiplin Ini Aturannya"},"content":{"rendered":"\n<p>Dalam dunia <em>blue collar, <\/em>pelanggaran terhadap aturan perusahaan merupakan hal yang cukup kerap terjadi, baik karena disengaja maupun tidak.<\/p>\n\n\n\n<p>Sebagai manusia, seorang karyawan tentu tak terlepas dari kesalahan, baik kecil maupun besar.<\/p>\n\n\n\n<p>Namun, jangan sampai kesalahan tersebut berbuah menjadi sebuah pelanggaran, ya.<\/p>\n\n\n\n<p>Meskipun demikian, perusahaan tak bisa serta-merta melakukan pemutusan hubungan kerja terhadap karyawan yang melanggar.<\/p>\n\n\n\n<p>Jika seorang karyawan sampai melakukan tindak pelanggaran, maka hal pertama yang dilakukan oleh perusahaan adalah memberikan surat peringatan alias SP.<br><br><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/staffinc.co.id\/manpower?utm_source=learn&amp;utm_medium=banner&amp;utm_campaign=contoh_surat_peringatan\"><img decoding=\"async\" src=\"https:\/\/staffinc.co.id\/wp-content\/uploads\/2021\/03\/manpower-banner-1-1024x299.png\" alt=\"sampingan manpower\" class=\"wp-image-16680\"\/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><br><strong>Dasar Hukum Pemberian Surat Peringatan<\/strong><\/h2>\n\n\n\n<p>Sebagaimana telah diatur dalam UU Ketenagakerjaan Pasal 151 Ayat 1 yang berbunyi:<\/p>\n\n\n\n<p>\u00e2\u0080\u009cPengusaha, pekerja\/buruh, serikat pekerja\/serikat buruh, dan pemerintah, dengan segala upaya harus mengusahakan agar jangan terjadi pemutusan hubungan kerja (PHK).\u00e2\u0080\u009d<\/p>\n\n\n\n<p>Aturan tersebutlah yang kemudian mendasari terbitnya SP sebagai sebuah bentuk teguran kepada karyawan yang melanggar aturan.<\/p>\n\n\n\n<p>SP diberikan secara bertahap, dari SP 1, SP 2, hingga SP 3, jika pelanggaran terus menerus dilakukan.<\/p>\n\n\n\n<p><br><strong>Baca juga:<\/strong> <a href=\"https:\/\/staffinc.co.id\/post\/langkah-penilaian-kinerja-karyawan\"><span class=\"has-inline-color has-vivid-cyan-blue-color\">5 Langkah Melakukan Penilaian Kinerja Karyawan, Cek Indikatornya!<\/span><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><br><strong>Manfaat Surat Peringatan<\/strong><\/h2>\n\n\n\n<p>Surat ini tentu saja tak selalu berarti buruk. Meskipun Namanya mengerikan, SP juga memiliki manfaat tersendiri baik bagi perusahaan maupun karyawan.<\/p>\n\n\n\n<p>Surat ini diberikan dengan tujuan memberikan efek jera bagi karyawan yang melanggar aturan.<\/p>\n\n\n\n<p>Tak hanya itu, karyawan lain yang menyaksikan juga diharapkan untuk tidak melakukan pelanggaran yang sama dan mengambilnya sebagai pelajaran.<\/p>\n\n\n\n<p>Dari sisi karyawan, SP berfungsi sebagai <em>buffer <\/em>agar ia tak langsung dipecat jika melakukan sebuah pelanggaran.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><br><strong>Aturan dan Ketentuan Menulis Surat Peringatan Menurut Undang-Undang<\/strong><\/h2>\n\n\n\n<p>Selain memiliki dasar hukum yang kuat, proses penyusunan SP  juga diatur dalam Undang-Undang, yakni UU Ketenagakerjaan Pasal 161.<\/p>\n\n\n\n<p>Berikut adalah aturan pembuatan surat peringatan sebagaimana tertuang dalam UU Ketenagakerjaan Pasal 161.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u00e2\u0080\u009c(1) Dalam hal pekerja\/buruh melakukan pelanggaran ketentuan yang diatur dalam perjanjian kerja, peraturan perusahaan atau perjanjian kerja bersama, pengusaha dapat melakukan pemutusan hubungan kerja, setelah kepada pekerja\/buruh yang bersangkutan diberikan surat peringatan pertama, kedua, dan ketiga secara berturut-turut.<br><br><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>(2) Surat peringatan sebagaimana dimaksud dalam ayat (1) masing-masing berlaku untuk paling lama 6 (enam) bulan , kecuali ditetapkan lain dalam perjanjian kerja, peraturan perusahaan atau perjanjian kerja bersama.\u00e2\u0080\u009d<\/li><\/ul>\n\n\n\n<p><br>Dari kutipan UU tersebut, dapat disimpulkan bahwa SP harus diberikan hingga tiga kali berturut-turut sebelum terjadi pemutusan hubungan kerja.<\/p>\n\n\n\n<p>Berturut-turut artinya dalam kurun waktu 6 bulan seperti yang telah tertuang di atas.<\/p>\n\n\n\n<p>Jika dalam kurun waktu 6 bulan karyawan tidak diberikan surat peringatan kedua, maka artinya ia terbebas dari SP pertama.<\/p>\n\n\n\n<p>Begitu pula sebaliknya.<\/p>\n\n\n\n<p>Jika dalam kurun waktu 6 bulan karyawan melakukan pelanggaran lain, maka SP kedua, bahkan ketiga, dapat diberikan.<\/p>\n\n\n\n<p>Hanya setelah SP ketiga diberikan, perusahaan berhak melakukan pemutusan hubungan kerja jika tak ada perbaikan dari karyawan.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><br><strong>Contoh SP untuk Karyawan<\/strong><\/h2>\n\n\n\n<p>Surat peringatan untuk karyawan harus ditulis dengan lengkap, mulai dari nama dan jabatan karyawan, hingga pelanggaran yang dilakukan.<\/p>\n\n\n\n<p>Tak cukup sampai di situ, alasan hingga tujuan pemberian surat pun harus ditulis dengan sejelas mungkin tanpa ambiguitas.<\/p>\n\n\n\n<p>Hal ini bertujuan untuk menghindari kesalahpahaman secara legal yang dapat merugikan baik perusahaan maupun karyawan.<\/p>\n\n\n\n<p>Berikut ini adalah contoh dari SP yang dapat diberikan kepada karyawan yang melakukan pelanggaran.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/staffinc.co.id\/wp-content\/uploads\/2021\/04\/contoh-surat-peringatan-791x1024.png\" alt=\"\" class=\"wp-image-18101\" width=\"580\" height=\"750\"\/><\/figure>\n\n\n\n<p>Demikianlah contoh surat peringatan karyawan yang dapat Anda buat.<\/p>\n\n\n\n<p>Jangan lupa perhatikan kaidah dan landasan hukumnya sebelum Anda mengeluarkannya.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dalam dunia blue collar, pelanggaran terhadap aturan perusahaan merupakan hal yang cukup kerap terjadi, baik karena disengaja maupun tidak.
